
Warranty Terms
1. Definitions
1.1 “Manufacturer” is Nordic Vitality OÜ (registration code 16867505).
1.2 “Product” refers to any bath (such as a ice bath, japanese bath) created by the Manufacturer for both indoor and outdoor use.
1.3 “Seller” is an authorized distributor of the Manufacturer.
1.4 “Customer” is the individual who has bought the Product from the Manufacturer or Seller for its intended purpose.
1.5 A “Defect” is a flaw or issue in the Product (including manufacturing or material defects) that hinders the Product from being used as intended.
2. The terms and conditions of the warranty are as follows:
2.1 The “Warranty” refers to the responsibility of the Manufacturer to address any Defects reported by the Customer or Seller during the Warranty Period, caused by the actions or oversights of the Manufacturer. This may include repairing the Defects or reimbursing the Customer or Seller for any costs incurred in fixing the issues, with prior approval from the Manufacturer. The method of remedying the Defect is at the discretion of the Manufacturer.
2.2 The warranty does not extend to third parties to whom the Customer has transferred the Product. Customers who are not consumers are not covered by the Warranty unless explicitly confirmed by the Manufacturer in writing.
2.3 The “Warranty Period” is 1 year for the Chilling/Heating Motor, Water pump and Ozone and electrical parts and 2 years for the structural, internal plumbing, internal glue joints, drains, hoses, all bonded parts from the delivery date of the Product to consumer Customers, but no more than 3 years from the manufacturing date. The onus of proof lies with the Customer or Seller to verify this information.
The warranty period for the product starts from the date of delivery to the customer and lasts for 2 years. If a defective product is replaced, the warranty period starts from the delivery of the replacement to the customer. If the product is repaired, the warranty period starts from the date of repair for the specific defect.
The warranty does not cover defects caused by improper installation or maintenance, usage, or storage of the product. It also does not cover damage caused by external factors such as extreme weather conditions or force majeure events. Natural wear and tear, as well as expected characteristics of wood materials, are not covered under the warranty. Defects that could have been detected through visual inspection before installation are also not covered.
2.4 Overall, the warranty is void if any of the mentioned conditions are not met.
The warranty for a defective product will not be honored if any of the following conditions are met:
a) the Customer fails to notify the Seller or the Manufacturer within 2 months of discovering the defect;
b) the Seller neglects to inform the Manufacturer within 2 weeks of becoming aware of the defect;
c) false information regarding the defect is intentionally provided by the Customer or Seller; d) the Seller does not pay the full invoice for the faulty Product;
e) the Customer continues to use the Product after discovering the defect without written consent from the Manufacturer; or
f) the Product is used publicly or under heavy conditions without prior written permission from the Manufacturer.
2.5 Any equipment installed in or included with the Product and provided by the Manufacturer is covered by the warranties offered by the equipment manufacturers and facilitated by the Manufacturer.
3. Submitting a warranty claim
3.1 To submit a warranty claim, the Customer must immediately stop using the Product upon discovering a defect and inform the Seller. If unable to contact the Seller or receive a response, the Customer can directly contact the Manufacturer to file a warranty claim.
3.2 When submitting a warranty claim, the following information must be included: Customer's name, address where the Product is located, contact details of the person filing the claim, and the Product's product code or name.
3.3 In the event that a serial number is available, please provide it along with the date of delivery or sale of the Product to the Customer, a detailed description of the Defect, and the preferred remedy of the Customer. Any warranty claim submitted must include a copy of the document certifying the date of delivery or sale, as well as clear photographs or videos showing the Defect from different angles.
3.4 The manufacturer will respond to the warranty claim within two weeks of receiving it. If the manufacturer is unable to determine if the Defect is covered by the warranty based on the information provided, further evidence and explanations may be requested from the person making the claim or the Seller. If the Defect is covered by the warranty, the manufacturer will outline the steps and timeline for remedying the issue.
4. Final provisions
4.1 The warranty provided does not affect the Customer's legal rights, including the right to seek remedies against the Seller under the law. While the manufacturer is not liable for consequential damages resulting from the use or inability to use the Product, the Seller may offer additional warranties on behalf of the Customer. The manufacturer will not be responsible for the fulfillment of such additional warranties.
